Terms of Use
These terms govern your use of the Zest Assure website at www.zestassure.com and the Zest Assure application at app.zestassure.com (together, the "service"). By accessing the website or signing in to the platform you agree to these terms. If you are using the platform on behalf of an organisation, your organisation's separate written agreement with us sets out the commercial terms of that subscription and takes precedence over these terms of use where the two differ.
Who we are
The service is provided by Zest Assure, a trading name of Juicy Media Ltd, registered in England & Wales under company number 05514688, with its registered office at DiSH, Heron House, 47 Lloyd Street, Manchester, M2 5LN. Juicy Media Ltd is registered with the Information Commissioner's Office under registration number Z1589829. You can reach us at hello@zestassure.com or on 0161 464 9252.
Using the website
You may view and use the public website for lawful purposes and for information about our platform. You must not use it in any way that breaches applicable law, interferes with its operation or security, attempts to gain unauthorised access to any part of it, or introduces malicious code. The accuracy and attribution standards we apply to the material we publish are described in our Editorial Policy.
Accounts and access
Access to the platform is granted per organisation and is approved before an account is created. When you sign in with a Microsoft or Google account you are responsible for keeping that identity secure and for activity carried out under your login. You must not share your access, attempt to access workspaces or data belonging to organisations you are not authorised to see, or use the platform to store or transmit unlawful, infringing or harmful content. We may suspend or withdraw access where these terms or your organisation's agreement are breached.
Acceptable use
When using the service you must not:
- break any applicable law or regulation, or encourage others to do so;
- attempt to probe, scan, disrupt or circumvent the security of the service or its infrastructure;
- copy, resell or make the platform available to third parties except as your organisation's agreement permits;
- upload content you do not have the right to use, or content that is unlawful, defamatory or infringing;
- use automated means to extract data from the service other than through interfaces we provide for that purpose.
Your content and personal data
Organisations keep ownership of the compliance content they create or upload; we process it only to provide the service, as described in our Privacy Policy and Data Protection Policy. How we meet our obligations under the UK GDPR is set out in our GDPR Policy, and our use of cookies is explained in our Cookies Policy. Where the platform offers AI drafting features, the output is generated to assist you and must be reviewed and approved by a person before it is relied upon; you remain responsible for the content you finalise.
Intellectual property
The Zest Assure platform, website, software and brand marks belong to Juicy Media Ltd or its licensors and are protected by intellectual property law. Nothing in these terms transfers any of those rights to you. The written, visual and software content on the service is governed by our Copyright Policy, and permitted references to our name and marks are covered by our Trade Marks Policy. Certification schemes and standards referenced on the service — including ISO 9001, ISO 27001 and Cyber Essentials — remain the property of their respective owners.
Availability
We work to keep the service available and secure, but we do not guarantee that it will be uninterrupted or error-free. We may update, suspend or withdraw all or part of the service for maintenance, security or operational reasons, and we may change features over time. Where your organisation holds a subscription, any service-level commitments are set out in its agreement with us.
Third-party links
The service may link to websites and resources operated by others. Those links are provided for convenience and we are not responsible for the content, products or practices of third-party sites. Accessing them is at your own risk and subject to the terms and privacy policies of those sites.
Disclaimers and liability
Zest Assure is a tool that helps organisations manage and evidence their compliance work; it does not itself grant, guarantee or replace any certification, audit outcome or legal compliance, and using the platform does not guarantee that any certification will be achieved. To the fullest extent permitted by law, the service is provided "as is" and we exclude implied warranties. We do not exclude or limit liability where it would be unlawful to do so — including for death or personal injury caused by negligence, or for fraud. Subject to that, our liability arising from your use of the free public website is limited; liability in connection with a paid subscription is governed by the limits set out in your organisation's agreement with us.
Changes to these terms
We may update these terms from time to time to reflect changes to the service, the law or our practices. The date at the top of the page shows when they were last revised, and your continued use of the service after a change takes effect means you accept the updated terms.
Governing law
These terms, and any dispute arising in connection with them, are governed by the laws of England & Wales and fall under the exclusive jurisdiction of the courts of England & Wales.
